Our Business Litigation attorneys are not just "litigators.” We are both advisors and trial lawyers with the deep courtroom experience to know what it takes to achieve the desired outcome within our clients’ budget, risk profile and time horizon.

Irving, Carlson & Xavier’s Business Litigation Group is comprised of experienced attorneys only. We do not hire litigation associates straight out of law school or use inexperienced junior associates, which means that we do not train associates at our clients’ expense. We generally staff cases "leanly" with partners, mid-level or senior associates, and experienced career paralegals who function at a high level with billing rates much lower than that of junior associates. Each case has a dedicated team involved in all facets of the case, who are accessible and available on our clients’ timetables. We are accustomed to working within budgets, and have developed cost-effective, focused strategies for achieving our clients’ goals.

Our client base ranges from successful entrepreneurs to the most prominent financial institutions in the world. Each client receives hands-on attention from the partner in charge of the matter, as well as the other members of the case team. Our attorneys appear in all New York courts (State and Federal), numerous other jurisdictions and before all administrative agencies and arbitral tribunals. We have extensive experience in New York’s state courts, including the New York State Supreme Court, Commercial Division and New York’s Appellate Divisions. We enjoy a reputation as lawyers who are both aggressive and practical, and who are not afraid to try a case. We also advocate all forms of alternative dispute resolution and have enjoyed tremendous success negotiating the settlement of complex business disputes through various dispute resolution mechanisms. We craft and consider potential business resolutions to our clients’ disputes. Many of our Business Litigation attorneys are also experienced transactional lawyers, and we work very closely with our corporate colleagues to develop efficient “out of the box” solutions to our clients’ business disputes. We also have the contacts and experience necessary to coordinate the public relations aspects of our clients’ high profile litigations, and we assist our clients with crisis management messaging both internally and externally.

Because of the reputation we have earned with our colleagues as trial lawyers, we are often hired to replace or supplement existing counsel and have developed methods to get up to speed quickly and efficiently. We frequently appear as trial counsel for colleagues in boutique or out-of-state law firms who are seeking experienced New York trial counsel to complement their skill sets. We are also routinely retained as special appellate counsel by clients and colleagues at other firms. We have developed a true collaborative approach for these representations, and we welcome the opportunity to work in conjunction with our colleagues from other firms on such matters.
